Terms of Service

Thank you for using Stitchist. We built it to help you turn your artwork into embroidery you can actually sew. Because we do not know every one of our customers personally, we have to put some Terms of Service in place.
When we say “Company”, “we”, “our” or “us” in this document, we are referring to Stitchist, a service operated from the United States. You can reach us at support@stitchist.app.
When we say “Services”, we mean our website at stitchist.app and the Stitchist embroidery digitizing application, whether used in a web browser or any other format we may offer.
When we say “You” or “your”, we are referring to the person who holds an account with the Services.
We may update these Terms of Service (“Terms”) in the future. Whenever we make a significant change, we will refresh the date at the top of this page and take any other appropriate steps to notify account holders.
When you use our Services, now or in the future, you are agreeing to the latest Terms. There may be times where we do not exercise or enforce a right or provision of the Terms; that does not mean we are waiving that right or provision. These Terms do contain a limitation of our liability.
If you violate any of the Terms, we may terminate your account. That is a broad statement, and it means you need to place trust in us. We try to deserve it.
Account Terms
- You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
- You may not use the Services for any purpose that is unlawful, that infringes someone else's rights, or that is designed to disrupt the Services for others.
- You are responsible for all content created under your account and all activity that occurs under it.
- You must be a human. Accounts registered by “bots” or other automated methods are not permitted.
- You must be at least 13 years old, and old enough to form a binding contract in your jurisdiction.
- We may require you to verify your email address before granting full access.
Payment, Refunds, and Plan Changes
- If you are using the free plan, it is really free: we do not ask you for your card and — just like for customers who pay — we do not sell your data.
- Pro is a one-time purchase, not a subscription. Nothing renews, and there is nothing to cancel. Once your account has Pro, it keeps Pro.
- Payment is processed by Stripe. Card details are submitted directly to Stripe and do not reach our servers. We store a record that the purchase happened.
- All fees are exclusive of taxes, levies or duties imposed by taxing authorities. Where required, we collect those and remit them to the relevant authority. Otherwise you are responsible for them.
- 14-day money-back guarantee. If Pro is not right for you, email support@stitchist.app within 14 days of the charge and we will refund it in full. We do not ask you for a reason.
- Pro includes priority support. Support is by email on both plans, and messages from Pro accounts are answered first. It is not a guaranteed response time.
- We may change the price of Pro. A change never affects a purchase already made.
Cancellation and Termination
- You may stop using the Services at any time. To close your account and erase everything it holds, email support@stitchist.app. There is no self-serve delete button; a person handles the request.
- Export anything you want to keep before you ask us to close the account. Once it is closed, its projects and version history are deleted and we cannot recover them for you.
- We have the right to suspend or terminate your account and refuse any current or future use of the Services for any reason at any time. Suspension means you cannot access the account or its content. Termination further results in deletion of the account and its content.
- Verbal, physical, written or other abuse (including threats of abuse or retribution) of anyone working on the Services will result in immediate account termination.
Modifications to the Service and Prices
- Sometimes it becomes technically impossible to continue a feature, or we redesign part of the Services because we think it could be better. We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of our Services with or without notice.
- We work to keep files you have exported usable, but we cannot guarantee that a design saved today will open unchanged in every future version of the editor.
Uptime, Security, and Privacy
- Your use of the Services is at your sole risk. We provide the Services on an “as is” and “as available” basis. We do not offer a service-level agreement.
- We take measures to protect and secure your data through backups, redundancy and encryption. Data is encrypted in transit between our servers and your browser.
- We reserve the right to temporarily disable an account whose usage significantly exceeds that of other customers, or which threatens the performance of the Services for everybody else.
- When you use the Services you entrust us with your data. You agree that we may process it as described in our Privacy Policy and for no other purpose. A human may access your data only to help with a support request you have made, to fix an error that has stopped an automated process partway through, to protect the security of the Services, or to the extent required by applicable law.
- We use third-party vendors and hosting partners to provide the hardware, software, networking and storage required to run the Services. The current list is in the Privacy Policy.
Your Designs and Content Ownership
- Your designs are yours. You give us a limited licence to store and process what you create in order to provide the Services to you, but we claim no ownership over it. You may sell what you make, including the stitch files you export and the goods you sew from them.
- You are responsible for having the rights to the artwork you upload. Do not upload material you have no right to use, and do not use the Services to infringe someone else's copyright or trade marks.
- We do not pre-screen content, but we reserve the right — not the obligation — in our sole discretion to refuse or remove any content held in the Services.
- The Company or its licensors own all right, title and interest in the Services themselves, including all intellectual property rights in them, and you obtain no ownership rights in the Services as a result of your use. You may not duplicate, copy or reuse any portion of the HTML, CSS, JavaScript or visual design elements without express written permission.
- Fonts, thread catalogues and fill patterns bundled with the Services are used under their own licences. Those licences cover your use of them inside the Services; they do not transfer to you separately.
Test-Stitching and Machine Safety
This section is specific to what Stitchist does, and it matters more than anything else on this page.
Stitchist generates stitch data and previews of it. A preview shows stitch placement — it is not a photograph of a finished result, and it cannot account for your fabric, stabilizer, thread, needle, hooping or machine.
Always test-stitch on scrap material, with the same stabilizer, before committing to a final piece. Always confirm which file format your machine prefers. You are responsible for what your machine does with a file. We are not liable for damaged garments, broken needles, thread breaks, machine faults, wasted material or lost time.
Features and Bugs
We design the Services with care, but there is no such thing as software that pleases everybody. We make no guarantees that our Services will meet your specific requirements or expectations.
We test features before shipping them. As with any software, ours inevitably has some bugs. We track the bugs reported to us and work through the priority ones, especially any related to security or privacy. Not all reported bugs will get fixed, and we do not guarantee error-free Services.
Liability
We mention liability throughout these Terms, but to put it in one place:
You expressly understand and agree that the Company shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained through the Services; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Services; (v) or any other matter relating to these Terms or the Services, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions our liability is limited to the smallest extent permitted by law, and nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded. If you are a consumer, you have statutory rights that these Terms do not affect.
In other words: choosing to use our Services does mean you are making a bet on us. If the bet does not work out, that is on you, not us. We do our best to be as safe a bet as possible.
Disputes
Stitchist is operated from the United States, and these Terms are governed by United States law. If you are a consumer resident outside the United States, you keep the benefit of any mandatory protections of your local law.
